What type of divorce situation are you facing? Most people are not sure or do not know where they stand when calling the attorney's office. Here is some help:
If the served party files an Answer, perhaps objecting to some of the statements within the document, the case will most likely proceed as a Contested Divorce.
If the parties are unable to agree on some or all issues, the case is considered
contested and the unresolved issues must be resolved by the court.
The case is considered uncontested if the parties are able to cooperate and agree on all issues outside of court. Usually a Settlement Agreement will work and the necessary signed paperwork is submitted for the court's signature.
Of course, if the served party signs the divorce papers, the matter is uncontested and once received by the court, the judge will sign and divorce the parties.
